Welcome to Be My Art.

By accessing this website or purchasing from us, you agree to the following Terms and Conditions. Please read them carefully before using this site or placing an order.

 

1. General Use

 

This website showcases and sells original artworks created under the Be My Art brand.

All content on this site — including artwork, images, text, branding, logos, and digital files — is the intellectual property of Be My Art and is protected by copyright and applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, or commercially exploit any content without prior written permission.

 

2. Products

 

Be My Art offers:

Digital art downloads

Open edition physical prints

Limited edition physical prints

Each product listing will clearly indicate the type of edition being offered.

 

3. Digital Products

 

Digital files are delivered electronically after successful payment.

Your purchase grants a non-exclusive, non-transferable personal-use license.

You may:

Print for personal display

Use as a digital background

You may not:

Resell or redistribute the file

Print for commercial purposes

Use on merchandise, NFTs, or promotional material

Remove or alter the artist’s signature

Claim authorship

All digital sales are final once delivered.

 

4. Physical Prints

 

Physical prints may be produced to order unless otherwise stated.

Shipping

Delivery timelines will be communicated at checkout or via email. We are not responsible for courier delays or circumstances beyond our control.

Damaged Items

If your print arrives damaged, contact us within 7 days of delivery with clear photographs of the damage and packaging. We will assess and arrange a replacement where appropriate.

Returns

As prints are produced to order, returns are not accepted unless the item arrives damaged or incorrect.

 

5. Payments

 

Payments are processed securely via PayFast.

We do not store or process your full payment card details.

Orders are processed once payment is successfully confirmed.

 

6. Limited Editions & Collector Prints

 

Certain artworks may be offered as limited edition prints.

Where specified:

Each print will be individually numbered (e.g., 1/52, 2/52, etc.).

The total edition size will be clearly stated.

Once sold out, the edition will not be reproduced in the same size and format.

Limited edition prints may be signed by the artist.

A Certificate of Authenticity (COA) may be included where stated in the product description.

Edition numbering reflects the total number of prints produced in that specific size and format. Future editions, if produced, will differ in size, material, or presentation.

Be My Art reserves the right to offer open editions or alternative formats of the same artwork unless explicitly stated that the work is permanently closed as a limited edition.

Collectors are encouraged to retain Certificates of Authenticity, as replacements cannot be guaranteed.

 

7. Refunds & Cancellations

 

Digital Products

All digital sales are final once delivered.

Physical Prints

Orders may only be cancelled before production begins. Once in production or shipped, cancellations are no longer possible.

 

8. Content Notice

 

This website may contain figurative artwork and themes intended for mature audiences.

By accessing this site, you confirm that you are at least 18 years of age, or of legal age in your region.

 

9. Website & Technical Limitations

 

We are not responsible for temporary downtime, hosting interruptions, payment gateway outages, or technical errors beyond our control.

 

10. Limitation of Liability

 

To the fullest extent permitted by law, Be My Art shall not be liable for:

Indirect or consequential losses

Colour variations due to screen calibration

Minor variations in print size or finish

Unauthorized use of digital files after download

 

11. Governing Law

 

These Terms & Conditions are governed by the laws of the Republic of South Africa.

 

12. Changes to These Terms

 

We may update these Terms periodically. Continued use of the site constitutes acceptance of any changes.
